These Terms of Use (the Terms) govern your access to and use of droppingnames.com and its related features (the Site), operated by Dropping Names, LLC (referred to as we, us, or our). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to misuse the Site, including by attempting to access areas or data you are not authorized to access, interfering with the operation or security of the Site, scraping or harvesting data, submitting spam, or using automated means to overload our systems. Some activities on the Site, such as entering a contest, may have a minimum age requirement, which is stated where it applies.
Newsletter and Communications
If you subscribe to our newsletter, you agree to receive emails from us. You may unsubscribe at any time using the link in any newsletter. We handle your information as described in our Privacy Policy.
Contests
Contests offered on the Site are governed by their own rules in addition to these Terms. For the Season 2 Logo Contest, please review the Official Contest Rules. If the rules and these Terms conflict with respect to a contest, the rules control for that contest.
Your Submissions
When you submit content to the Site, such as contest artwork, an application, or a message, you represent that you have the right to submit it and that it does not infringe the rights of others or violate any law. You are responsible for the content you submit. Except as stated in a specific contest rules or elsewhere, you retain ownership of your submissions, and you grant us a non-exclusive, worldwide, royalty-free license to use, host, display, and reproduce your submission as needed to operate and promote the Site and the show, with credit where practical. We may remove content that we believe violates these Terms or is otherwise objectionable.
Intellectual Property
The Site and its content, including text, graphics, logos, and design, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our permission, except as allowed by these Terms or applicable law.
Third-Party Links and Services
The Site may link to third-party websites and services, such as podcast platforms. We are not responsible for the content, policies, or practices of those third parties. Your use of them is at your own risk and subject to their terms.
Orders and Payment
The shop is operated by us, not by a third party. Prices are in US dollars. Card payments are processed by Square on their own secure pages; we never receive or store your card details. An order is accepted when Square confirms your payment and we email you a receipt. We may decline or refund an order, for example if an item is unavailable or a price is listed in error.
Delivery
Physical items are posted from Los Angeles. Postage is a flat ten US dollars within the United States and twenty US dollars elsewhere, shown before you pay. Please allow a week or two. The studio visit is not a physical item: nothing is posted, and we will contact you by email to arrange a date.
Personalised Video Messages
A video message is recorded to order from the brief you submit, so please check it before you pay. We aim to record and email it within seven days. Brent and Jonathan can decline any request they are not comfortable with; if that happens, or if we cannot deliver it, you get a full refund. The video is for your own personal use. Because each one is made specifically for you, it cannot be cancelled or returned once it has been recorded.
Returns and Cancellations
Gum is a food product, so we cannot accept it back once it has been sent. If it arrives damaged, or does not arrive at all, email us and we will replace it or refund you. For the studio visit, dates are arranged by agreement and subject to availability. If we cannot agree a date that works, or we have to cancel, you get a full refund. Email studio@droppingnames.com about anything to do with an order.
Disclaimers
The Site is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error free.
Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
Changes to the Site and These Terms
We may modify or discontinue the Site, or any part of it, at any time. We may also update these Terms from time to time. When we do, we will revise the date at the top of this page. Your continued use of the Site after an update takes effect means you accept the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in California.
